Conditions

  1. scope
    1.1. These general terms and conditions (hereinafter "GTC") regulate the contractual relationship between Rötheli Racing (hereinafter referred to as "seller") and the customer (hereinafter referred to as "customer") for the purchase of car and tuning parts via the seller's online shop.

  2. conclusion of contract
    2.1. The presentation of the goods in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order. By submitting an order, the customer makes a binding offer to purchase the selected goods.
    2.2. The seller reserves the right to accept or reject the customer's offer within 48 hours of receipt. The acceptance takes place by sending an order confirmation by e-mail or by shipping the ordered goods.

  3. Prices and terms of payment
    3.1. All prices are in Swiss francs (CHF) and include the statutory VAT.
    3.2. Payment can be made using various payment methods. The customer selects the desired payment method in the ordering process.
    3.3. The customer undertakes to pay the purchase price within 48 hours after receipt of the order confirmation or invoice.

  4. delivery and shipping
    4.1. The goods ordered are delivered to the delivery address specified by the customer.
    4.2. The shipping costs will be communicated to the customer before completing the ordering process and are to be borne by the customer, unless otherwise agreed.
    4.3. The delivery time may vary depending on the availability of the goods. The seller will inform the customer about possible delays.
    4.4. The customer is obliged to immediately check the delivered goods for completeness and defects. Any defects must be reported to the seller in writing within 48 hours of receipt.

  5. right of withdrawal
    5.1. The customer has a statutory right of withdrawal.

  6. Warranty and liability
    6.1. The seller warrants that the delivered goods are free from defects at the time of delivery.
    6.2. The liability of the seller for damage caused by simple negligence is excluded, provided that no essential contractual obligations, damage from injury to life, limb or health or guarantees are affected.

  7. data protection
    7.1. The seller undertakes to comply with the applicable data protection regulations.

  8. returns
    9.1. Returns and returns of goods are only possible after prior agreement with the seller.
    9.2. The customer undertakes to send returned goods in perfect condition and in the original packaging.
    9.3. The seller reserves the right to refuse returned goods or to claim an appropriate reduction in value if the goods are not returned in perfect condition or without prior agreement.
    9.4. The cost of returning the goods is borne by the customer, unless the return is due to a defect for which the seller is responsible or a faulty delivery.

  9. Final Provisions
    9.1. Swiss law applies to the exclusion of the UN Sales Convention.
    9.2. Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
    9.3. The place of jurisdiction for all disputes arising from the contractual relationship between the seller and the customer is the seller's registered office.
